A CNN report Thursday claims the DOJ declined a request from the FBI to investigate the Clinton Foundation but Judge Napolitano says that’s false.
NAPOLITANO: The Justice Department can order the FBI to engage in an investigation, it cannot stop the FBI from engaging in an investigation as to which it has evidence. The FBI is an independent agency obliged by the law and the fiduciary duty that its employees have to go where the evidence takes them no matter who the evidence brings them to.

The Judge said the FBI is investigating the Clinton Foundation because the evidence of public corruption is “overwhelming.”
NAPOLITANO: I’m telling you that the FBI is investigating the Clinton Foundation because the evidence of public corruption of Mrs. Clinton making decisions as the sitting secretary of state using the authority of the secretary of state that she obtained from the federal statutes in order to benefit her husband and her husband’s foundation is simply overwhelming and cannot be avoided. This case of public corruption, I’ve been arguing Clayton, is easier for the public to understand, easier for a jury to understand, easier for the government to prove than who did what with emails.
Napolitano described why the foreign donations to the Clinton Foundation are so shady.
NAPOLITANO: That is about people making application – emails showing – that foreign governments, foreign groups and foreign persons made applications to Mrs. Clinton for exemptions from complying with American law. She has the authority to grant those exemptions – secretaries of state do it all the time. But as soon as she granted these exemptions to these people what did they do? Made enormous contributions to the Clinton Foundation!
