Massachusetts' Inverted Burden of Proof Standard Made a Lindsay Clancy Guilty Verdict Incredibly Hard to Deliver
The fact that Lindsay Clancy was not convicted of murdering her three children was a travesty of justice. It was also incredibly difficult to convict Lindsay Clancy, given the facts, of murdering her three children.
Those two facts may seem contradictory. They’re not, and you have progressive criminal justice reformers in arguably America’s most progressive state to thank for this paradox.
On Friday, Judge William Sullivan declared a mistrial in the Clancy case with the jury deadlocked 11-1 in favor of finding her not guilty by reason of insanity. The lone holdout juror, one of the three men on the panel, was held up as a hero by many on social media, where discourse about the case has been both heated:
